General terms of sale
This website (the "Site") is the exclusive property of Sergio Capone SRL, via Borgo Stretto, 6 Pisa (I), Italy. Use of the Site constitutes implicit acceptance of the terms and conditions set forth below.
Parties
Customer: the person identified by the data entered at the time of registration and acceptance of these general conditions.
Service Object
Through the e-commerce service, the Supplier makes available to the Customer a virtual store from which it is possible to view and purchase products from the Supplier itself. The Customer can view the Supplier's electronic catalog and offers and make purchases from the Supplier based on these terms of sale.
Acceptance of the general terms of sale
The customer can only purchase products that are available on the Site at the time of access by the customer, according to the quantities indicated therein. To make a purchase, the customer, by accessing the Site, must first register and then place a specific order, following the instructions and computer procedures provided therein.
Important: When making a purchase, the customer must provide a personal, valid, and regularly active email address.
The general terms of sale may be updated or modified at any time by www.sergiocapone.com, which will provide notice through the pages of the website. The Customer, by electronically submitting the confirmation of their purchase order, unconditionally accepts and undertakes to observe, in their relations with www.sergiocapone.com, the general terms of sale, including the payment conditions illustrated below, declaring to have read and accepted all the information provided.
Prices and Warranty
All sales prices of the marketed products are displayed and indicated on the www.sergiocapone.com website; they constitute a public offer pursuant to art. 1336 of the Italian Civil Code. Unless otherwise specified in writing, all indicated prices are to be understood as "VAT included" and expressed in Euros.
Shipping costs: Shipping costs are excluded from the price of the item and, indicated separately, are to be borne by the Customer.
The validity of the indicated prices is always and solely that indicated by the procedure at the very moment the order is forwarded to the Supplier.
Products are delivered anywhere in Italy. Abroad, delivery is made only to the countries listed in the specific list on the Site, where transport, shipping and insurance costs are also indicated, which the customer must check before confirming their purchase.
For international deliveries, in countries where this is foreseen, supplementary transport, shipping and insurance costs, as indicated from time to time, as well as taxes and/or duties provided by the regulations of the transit and/or destination country/countries applicable from time to time, are payable by the customer.
Customer Obligations
It is strictly forbidden for the Customer to enter false, and/or invented, and/or fictitious data in the registration procedure necessary to activate the process for the execution of this contract and the related further communications; personal data and email must exclusively be their real personal data and not those of third parties, or fictitious data.
Absolute prohibition: It is expressly forbidden to enter third-party data. The Supplier reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers.
The Customer indemnifies the Supplier from any liability arising from the issuance of incorrect tax documents due to errors related to the data provided by the customer, as the customer is solely responsible for correct entry.
In case of non-collection of goods by the customer, shipping costs and any charges incurred will be borne by the customer, and therefore deducted from the amount to be refunded.
Delivery Methods and Times
sergiocapone.com will deliver the requested product to the customer, using trusted couriers and/or forwarders. In case of absence of the customer/recipient at the time of delivery, it will be possible to arrange a new delivery.
Check upon delivery: Upon receipt of the goods at their home, the Customer must check the integrity of the package and the quantitative and qualitative correspondence with what is indicated in the accompanying document.
Except in cases of force majeure, the purchased product is delivered to the customer approximately within 7 (seven) working days from the order or, in any case, within a maximum of 30 (thirty) days from the order.
No liability can be attributed to www.sergiocapone.com for delayed or failed delivery due to force majeure or unforeseeable circumstances.
Right of Withdrawal
Pursuant to art. 64 of Legislative Decree no. 205/06, the customer may exercise the right of withdrawal and return the product received purchased online on our website, in compliance with the terms and conditions indicated below.
The customer will be entitled to a refund of the price, shipping costs, and return costs for the return of defective products or products delivered that do not correspond to the order placed by the customer or in case of damage due to transport or shipping errors by Sergio Capone srl.
Return terms: Returns are possible for any reason within 10 days from the moment delivery was made.

Once the return is requested, the item must be placed back in its original packaging and complete with all attached materials. We will send the shipping label by email, which the customer must print and attach to the package. We will always take care to arrange for courier pickup.
The refund will take place after the returned products have been received. If the return does not meet the listed conditions, the refund will not be issued. Once the condition of the goods has been verified, the refund will be made within thirty (30) working days using the same payment method used by the customer for purchase: any customs duties for return to Italy will be deducted from the value of the returned purchase.
Essential conditions: It should be noted that the integrity of the product to be returned is an essential condition for exercising the right of withdrawal and that Sergio Capone srl will carry out the necessary checks upon return. The product must be returned together with its original packaging, relevant documentation, and any additional components, without exception.
Validity of Communications
The Supplier is not responsible for any fraudulent and illegal use that may be made by third parties of credit cards or other payment methods, at the time of payment for purchased products.
Payment Security: The Supplier is never able, at any point in the purchase process, to know the Customer's credit card details, as the Customer will transmit them directly to the payment service provider without intermediaries and will be automatically reconnected to the Supplier's website at the end of the process.
For all online services on the site, the connection costs applied by the Provider used by the Customer for the connection itself apply, to whom the Customer must refer to obtain the necessary information.
Jurisdiction and Competent Court
These general terms of sale are governed by the laws of the Italian Republic. The Italian Judicial Authority has jurisdiction over any dispute.
Except as may be provided by mandatory legal provisions, the Court of Pisa shall have exclusive jurisdiction.
Intellectual Property
All elements of the Site, whether or not subject to intellectual property rights registration (photos, product sheets, descriptions, layouts), are the exclusive property of Sergio Capone SRL and cannot be used.
All designs, models, brands, texts, visual or audio elements, comments, works, illustrations, images, reproduced on the www.sergiocapone.com Site are protected by copyright, trademark rights and image rights and any other applicable intellectual property right. They are the total property of Sergio Capone SRL or its partners.
Warning: Any type of reproduction or representation, subject to counterfeiting, may lead to civil and criminal liability of its author.
Links that refer to the www.sergiocapone.com Site and that use "framing" or "in-line linking" techniques are formally prohibited. In any case, any link or other content mentioned above, even if tacitly authorized, must be removed immediately and upon simple request by Sergio Capone SRL, under penalty of legal consequences.
